1. Planning Permission & Permitted Development

1.1 The Customer is solely responsible for ensuring that the proposed garden room complies with all Permitted Development rights, planning regulations, building regulations, covenants, and any other restrictions imposed by their local authority or property deeds.

1.2 The Company does not accept responsibility for confirming whether the installation falls within Permitted Development or requires planning permission.

1.3 Any advice provided by the Company regarding planning or Permitted Development is offered in good faith and should not be relied upon as professional planning advice.

1.4 The Company shall not be held liable for any costs, losses, enforcement action, delays, alterations, or removal of the building arising from failure to obtain the correct permissions or approvals.

1.5 If planning permission or other approvals are required and not obtained prior to installation, the Customer accepts full responsibility for any consequences.

2. Ownership of Materials

2.1 All materials, components, and goods supplied by the Company remain the sole property of the Company until the invoice has been paid in full, including any outstanding balances, variations, or additional charges.

2.2 Until full payment is received, the Company reserves the right to:

• Suspend work

• Withhold delivery of materials

• Recover materials already delivered to site, where reasonably possible

2.3 Risk in the materials may pass to the Customer upon delivery; however, legal ownership does not transfer until payment is made in full.

3. Payment

3.1 Payment terms will be set out in the quotation or invoice.

3.2 Failure to pay in accordance with agreed terms may result in delays, suspension of works, or termination of the contract.

4. Limitation of Liability

4.1 The Company shall not be liable for indirect or consequential losses, including but not limited to planning-related costs or enforcement action resulting from non-compliance with local authority regulations.

4.2 Nothing in these terms limits the Company’s liability for death or personal injury caused by negligence or for any matter which cannot be limited under UK law.
